These Terms of Service ("Terms") govern your access to and use of the Olympus Performance Lab mobile application and related services (the "App"), operated by AYHAM AL-BASHAYREH SOFTWARE TECHNOLOGY ESTABLISHMENT ("we," "us," or "our").
By creating an account, purchasing a subscription, or using the App, you agree to be legally bound by these Terms. If you do not agree, you must not use the App.
1. Eligibility
You must be at least 13 years old to use the App. If you are under 18, you represent that you have permission from a parent or legal guardian.
2. Accounts and Security
Certain features require account registration using email/password or third-party authentication providers (such as Apple or Google).
You are responsible for maintaining the confidentiality of your credentials and for all activities occurring under your account. You agree to notify us immediately of unauthorized access.
3. User Content
You retain ownership of content you upload, including workout logs, performance metrics, biometric data, notes, and training programs ("User Content").
You grant us a limited, worldwide, non-exclusive license to host, store, process, display, and transmit User Content solely for operating and improving the App.
We reserve the right to remove or restrict User Content that violates these Terms or applicable laws. We are not obligated to monitor User Content.
4. Coaching and Social Features
The App enables optional coaching and collaborative interactions between users. Olympus Performance Lab is a software platform only and does not supervise, verify, endorse, or assume responsibility for coaching decisions.
Coaches are not medical professionals unless explicitly stated. All training decisions are made voluntarily and at your own risk.
5. Assumption of Risk and Health Disclaimer
Physical training and athletic performance activities involve inherent risks, including injury, illness, disability, or death.
By using the App, you voluntarily assume all risks associated with physical activity and release AYHAM AL-BASHAYREH SOFTWARE TECHNOLOGY ESTABLISHMENT from any claims arising from participation in training programs or use of performance data.
The App does not provide medical advice and is not a medical device. Consult a qualified healthcare professional before beginning any training program.
6. Subscriptions and Payments
Certain features require a paid subscription. Subscriptions are processed exclusively through the Apple App Store or Google Play Store.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the billing period. You may manage or cancel subscriptions through your Apple or Google account settings.
All billing, refunds, and payment disputes are handled by the platform through which you subscribed. We do not process payments directly.
7. Acceptable Use
- Using the App for unlawful or harmful purposes
- Attempting to access other users' data without authorization
- Reverse-engineering, copying, or exploiting the App
- Uploading malicious, infringing, or harmful content
8. Intellectual Property
All software, branding, trademarks, analytics systems, and design elements are the exclusive property of AYHAM AL-BASHAYREH SOFTWARE TECHNOLOGY ESTABLISHMENT. Unauthorized use is prohibited.
9. Service Availability
The App is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted, secure, or error-free operation.
10. Disclaimer of Warranties
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee accuracy of performance metrics, biometric calculations, analytics, or coaching outcomes.
11. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages.
Our total aggregate liability for any claim arising from use of the App shall not exceed the total amount paid by you to us in the twelve (12) months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless AYHAM AL-BASHAYREH SOFTWARE TECHNOLOGY ESTABLISHMENT from any claims, damages, losses, liabilities, and expenses arising from:
- Your use or misuse of the App
- Your User Content
- Your coaching activities or advice
- Your violation of these Terms or applicable law
13. Termination
We may suspend or terminate your account if you violate these Terms or applicable laws.
14. International Use
The App may be accessed globally. You are responsible for compliance with local laws in your jurisdiction.
15. Governing Law
These Terms are governed by the laws of the Hashemite Kingdom of Jordan, without regard to conflict-of-law principles.
16. Changes to These Terms
We may update these Terms from time to time. Continued use of the App after updates constitutes acceptance of the revised Terms.
17. License and Use of the App
The App is licensed, not sold, to you. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.
